These Terms and Conditions ("Terms") apply to The Kreator Co mobile application (hereby referred to as the "Application"), owned and operated by FAASLEY MARKETING PRIVATE LIMITED (hereby referred to as the "Service Provider"), a company incorporated under the laws of India.

The Application is offered as a Freemium service. Upon downloading, accessing, or utilizing the Application, you ("User") automatically agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the Application.

1. Intellectual Property & Scope of Use

  • Ownership: All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the absolute property of the Service Provider. Unauthorized copying, modification of the Application, or attempts to extract the source code, translate the Application, or create derivative versions are strictly prohibited.

  • Service Modifications: The Service Provider reserves the right to modify the Application or introduce fees for its services at any time and for any reason. Any changes to pricing or billing structures will be clearly communicated to you in advance.

2. Data Security & Device Compliance

  • Account Security: The Application stores and processes personal data provided by you to deliver the Service. It is your sole responsibility to maintain the security of your device and access credentials.

  • Device Restrictions: The Service Provider strongly advises against jailbreaking or rooting your device. Removing software restrictions imposed by your official operating system exposes your device to malware, compromises security features, and may cause the Application to malfunction or fail completely.

3. Third-Party Integration & Connectivity

The Application utilizes trusted third-party services which govern their operations under their respective Terms and Conditions:

  • Google Play Services

  • Google Analytics for Firebase

  • Firebase Crashlytics

  • Meta / Facebook

  • Sentry

  • Network Charges: Certain features of the Application require an active internet connection (Wi-Fi or mobile data). The Service Provider is not responsible for reduced functionality if you lack data access or have exhausted your data allowance. You accept responsibility for all data and roaming charges incurred from your mobile network provider.

4. General Platform Terms (Applicable to All Users)

4.1 Platform Role

The Kreator Co acts strictly as an commercial intermediary infrastructure facilitating collaborations between Brands and Influencers. The Service Provider provides the platform for engagement but does not guarantee specific campaign performance, ROI, or engagement metrics.

4.2 Transparent Payment Structure & Escrow-Like Hold Process

To ensure transaction security, fraud prevention, and payment gateway compliance, the platform utilizes the following payment workflow:

  • Advance Payments: Brands deposit campaign funds with the Service Provider in advance. These funds are held securely until campaign completion.

  • Deliverable Validation: Upon fulfilling the campaign requirements, the Influencer must submit a "Request Submission" via the Application for validation.

  • Payment Release: Once the Brand approves the submitted deliverables, the Service Provider safely releases the designated funds to the Influencer's platform wallet.

  • Non-Refundable Subscription Fees: All payments made for platform subscriptions, administrative fees, or structural campaign creation fees are final and non-refundable.

4.3 Goods & Services Tax (GST) & Gateway Charges

All commercial transactions, subscription charges, and processing fees executed on the platform are subject to statutory taxes, including Goods and Services Tax (GST) at the prevailing rate (currently 18%), along with applicable payment gateway convenience fees.

4.4 Product Logistics Disclaimer

For campaigns involving physical product exchanges, the Service Provider acts solely as an intermediary. The Service Provider holds no responsibility for the quality, safety, shipping, delivery, or cost of products sent directly from Brands to Influencers. Any issues arising from missing, broken, or unreturned products remain strictly a bilateral dispute between the Brand and the Influencer.

4.5 Digital Wallet System

  • Brand Wallet: Funds can be added via approved payment gateways to sponsor campaigns. Wallet balances cannot be withdrawn or refunded to a bank account except under valid, verified dispute settlements.

  • Influencer Wallet: Funds earned through approved collaborations are credited here and can only be withdrawn to a verified, linked Indian bank account. Influencers cannot top up or recharge this wallet.

  • Platform Limitation: Wallet credits hold no real-world cash alternative outside of the ecosystem and cannot be transferred to third parties outside the Application.

5. Terms for Influencers

5.1 Subscription & Platform Access

  • Influencers must maintain an active monthly subscription fee to gain access to premium, paid brand collaborations.

  • Failure to clear subscription fees will result in immediate suspension of access to premium features.

  • All subscription fees are subject to 18% GST.

5.2 Campaign Compliance & Deliverables

  • Influencers must strictly adhere to the creative brief and guidelines provided by the Brand.

  • Content must be entirely authentic, non-misleading, and strictly compliant with the Advertising Standards Council of India (ASCI) regulations and consumer protection laws.

  • Failure to upload deliverables within the stipulated deadline or violation of guidelines may result in the forfeiture or withholding of payment.

5.3 Taxation & Payouts

  • Withdrawals are processed to the Influencer's verified, linked Indian bank account.

  • Tax Deducted at Source (TDS): In compliance with Indian Income Tax regulations, TDS at 1% (or the prevailing statutory rate) will be deducted under Section 194C of the Income Tax Act.

  • Influencers are legally required to provide a valid Permanent Account Number (PAN) and correct bank account routing details to facilitate payouts.

5.4 Prohibited Activities

Any use of fake engagement tactics (including but not limited to bots, click-farms, fake followers, or misleading metrics) or fraudulent misrepresentation will result in immediate termination of the account and forfeiture of any pending wallet balance.

6. Terms for Brands

6.1 Campaign Execution & Fees

  • Brands must clear a non-refundable campaign creation and processing fee to launch a marketing campaign on the platform.

  • Timeline Clause: For campaigns initiated or created within specific legacy cycles (e.g., March 2025), campaigns are scheduled to go live systematically during the first week of that respective operational cycle.

6.2 Content Review & Compliance Policy

To maintain high ecosystem standards, all brand campaigns undergo a mandatory compliance review before publishing. The Service Provider reserves the absolute right to reject campaigns that feature:

  • Misleading or unsubstantiated claims.

  • Hate speech, defamation, or racially insensitive material.

  • Copyright, trademark, or intellectual property violations.

  • Unethical promotions or products restricted under Indian Law.

6.3 Dispute Resolution & Fraud Protection Refund Policy

If an Influencer fails to deliver the agreed-upon marketing content, or if the content violates explicit brand guidelines, the Brand may formally raise a dispute within the application.

  • The Service Provider will execute a manual verification process evaluating the evidence.

  • If the Brand's claim is verified as valid, a refund of the held campaign escrow amount will be processed back to the source account or platform wallet.

  • The final, non-appealable decision regarding dispute resolution rests entirely with the Service Provider.

6.4 Campaign Inactivity & Housekeeping

If a campaign demonstrates prolonged inactivity, the Service Provider reserves the right to initiate a manual verification check. The platform support team will reach out to the brand via registered communication channels. If no corrective activation steps are taken by the Brand post-outreach, the Service Provider may archive or remove the campaign to protect user engagement metrics.

7. Comprehensive Liability Disclaimer

  • No Warranty: The Service Provider provides the platform on an "As-Is" and "As-Available" basis. We do not warrant that the application will be uninterrupted, error-free, or completely secure.

  • Limitation of Liability: To the maximum extent permitted by applicable law, FAASLEY MARKETING PRIVATE LIMITED shall not be liable for any direct, indirect, incidental, punitive, or consequential damages, financial losses, loss of data, third-party data breaches, regulatory non-compliance of users, or tax liabilities incurred by either Brands or Influencers utilizing the platform.

8. Communication Consent

By creating an account and submitting your information, you grant explicit authorization to the Service Provider to contact you via telephone calls, RCS, WhatsApp messages, or emails for administrative, operational, updates, and promotional purposes. You may opt out of promotional messages at any time by contacting our support team.

9. Data Sharing & Privacy Compliance

The Service Provider collects and handles user data strictly to maintain platform operations and improve service efficiency. Anonymized, aggregated data sets may be shared with trusted analytics providers (e.g., Google, Meta, Firebase). For comprehensive information, please refer to our Privacy Policy.

10. Governing Law & Dispute Resolution

These Terms shall be governed by, interpreted, and construed in accordance with the laws of India. Any legal conflict, dispute, or claim arising out of or relating to these terms, or the breach thereof, shall be settled exclusively through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Udaipur, Rajasthan, and the proceedings shall be conducted in the English language.

11. Account Termination

The Service Provider reserves the right to terminate or suspend access to the Application instantly, without prior notice or liability, for any breach of these Terms. Upon termination, all rights and licenses granted to you cease, and you must immediately delete the Application from your device.

12. Amendments to These Terms

The Service Provider may update these Terms and Conditions periodically to reflect changing regulatory environments or product upgrades. You are advised to review this policy regularly. Changes become legally binding immediately upon being posted on this page within the Application.
